U.S. Trade Rep. Actions re Existing 301 Exclusions

Written by Susan Kohn Ross

On May 30, 2024, the USTR published in the Federal Register its decisions regarding the existing China 301 tariffs. See here. There are four (4) annexes to consider.

Annexes A and B list products where the extension will be extended to June 14, 2024 and expire thereafter.

Annex C products will be extended to May 31, 2025, and Annex D products expired, as expected, on May 31, 2024. For those who are interested in filing comments regarding the results of USTR’s four (4) year study, the portal has opened and can be found at https://comments.ustr.gov/s/. As of June 2, 2024, there are five (5) comments on file (on behalf of three (3) companies), only one (1) of which seems to be complete. The remainder are incomplete in that, even where comments were filed, not all of the questions in the relevant section reflect a response. It may be prudent to consult with your professional trade advisors to figure out how best to proceed regarding the products you import as responding to all of the questions in a given section should be carefully crafted.
